By licensing and performing When This Is Over you accept and agree to be bound by the terms and provisions of this agreement.

1. Privacy and personal information

The personal information we require from you, as well as details of the company performing this play, is used to facilitate your participation in this project. We retain this information in order to contact you regarding your enquiry or licence, to supply you with any licence we may subsequently issue, and as a record of your participation. We will pass this information on to Company Three for the purposes of your participation in this project. We will not pass on this information to any other third party.

You can check what details we hold for you by contacting the Nick Hern Books Performing Rights Department, and can ask for those details to be amended or, after the period covered by the licence, removed from our system.

 

2. Payment

Payment of the invoice for your licence can be made anytime from the date of issue, and must be made in full ahead of your first performance or by Friday 22 October 2021, whichever is sooner. If your participation form is submitted after Friday 22 October 2021, payment must be made immediately.

Payment must be made in pounds sterling. Payment can be made by bank transfer, PayPal invoice, or by card over the phone. You must quote your invoice number when making payment. Please do not make payment before receiving an invoice.

You will receive a receipt for your payment by email. This receipt acts as your licence. If you have not made payment ahead of your first performance or Friday 22 October 2021, your production is not licensed, you will be in breach of copyright law and your space in this project may be given to another company. If you have made payment but not received the receipt ahead of your first performance, please contact the Nick Hern Books Performing Rights Department.

 

3. Your licence

Performing rights for When This Is Over are non-exclusive.

The availability of performing rights for this play are guaranteed to you once you have received confirmation from the Nick Hern Books Performing Rights Department by email.

Your licence to perform When This Is Over grants you the rights for four performances (to be staged between 1 September 2021 and 28 February 2022), a printable copy of the Blueprint, and access to all of the resources required to stage your production.

For the avoidance of doubt, any performing rights granted are personal to you, the Licensee, who shall not be entitled to authorise third-party performance, broadcast, streaming or hosting of the production. All rights not specifically referred to herein are reserved to Nick Hern Books on behalf of Company Three.

 

4. Changes to your licence

You must immediately inform the Performing Rights Department of any changes to your licence, including a change in venue, dates, or number of performances.

If your production is cancelled for any reason and you need to terminate your licence, you can do so at any time prior to the date of your first performance and receive a full refund, minus an administration fee. If your production has already started and you need to cancel one or more performances, you can do so and receive the equivalent refund. Refunds will incur an administration fee of £10.

 

5. Marketing and advertising

The term ‘marketing material’ here refers to print or digital posters and flyers, video or audio trailers and previews, website listings, and theatre or festival programmes.

Any and all marketing material for your performance must include the title of the play, as well as the following credits:

  • Devised by [Your Company Name, OR ‘the company’] in association with Company Three
  • Performed by arrangement with Nick Hern Books

If a listing for your production is subject to a character limit, please contact the Nick Hern Books Performing Rights Department for advice on meeting these requirements.

 

6. Recording and sharing material

You are permitted to make audio and/or video recordings of your rehearsals and/or performance of When This Is Over. Included in your licence is an invitation to submit text, video and/or audio excerpts from your rehearsals and/or performance to Company Three's When This Is Over Online Hub.

You are permitted to share these excerpts publicly for marketing purposes. This material must adhere to the terms laid out in Section 5 of this agreement.

By submitting these excerpts to the Online Hub, or sharing them publicly, you confirm that you have obtained the correct permissions from the relevant young person and their guardian for their contribution to be shared on a public website.

This material must not be sold or passed on to a third party.

When This Is Over is intended to be performed at a venue in front of a physically present audience. If, due to COVID-19 restrictions or other extenuating circumstances, you need to perform your full production of When This Is Over online, you must contact the Nick Hern Books Performing Rights Department.

 

7. Music and lyrics

You will be responsible for clearance of copyright and payment of fees required for the use of any music and lyrics in connection with your production. Please enquire with your performance venue or contact PRS For Music.
